1. Agreement to Terms

By accessing or using the services provided by Hamad Web Designs ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Services Description

Hamad Web Designs provides professional web design and development services, including but not limited to:

• Custom website design and development
• E-commerce website development
• Website redesign and optimization
• SEO services and performance optimization
• Website hosting and maintenance
• Ongoing support and updates

3. Subscription and Payment Terms

3.1 Monthly Subscription

Our web design services are offered on a monthly subscription basis. The subscription fee is $299 per month unless otherwise agreed upon in writing. Payment is due on the same day each month and will be automatically charged to your payment method on file.

3.2 No Upfront Fees

We do not require upfront payment for website design and development. Your subscription begins once your website is launched and goes live.

3.3 Cancellation Policy

You may cancel your subscription at any time by providing written notice. Cancellation will take effect at the end of your current billing cycle. Upon cancellation, access to your website and associated services may be discontinued unless alternative hosting arrangements are made.

4. Intellectual Property Rights

4.1 Client Content

You retain all rights to the content you provide (text, images, logos, etc.). You grant us a license to use this content solely for the purpose of providing our services.

4.2 Website Design and Code

While you subscribe to our services, you have the right to use the website we create for you. However, the underlying code, design frameworks, and proprietary elements remain the property of Hamad Web Designs. Upon request after a minimum of 12 months of service, we can discuss transferring full ownership rights.

4.3 Third-Party Assets

Any third-party assets used in your website (stock photos, fonts, plugins, etc.) are subject to their respective licenses and terms of use.

5. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information necessary for project completion
• Respond to our communications in a timely manner
• Provide content, images, and materials as requested
• Ensure you have the right to use all content you provide
• Maintain current payment information
• Notify us of any issues or concerns promptly

6. Service Level and Support

6.1 Uptime and Availability

We strive to maintain 99.9% uptime for hosted websites. However, we do not guarantee uninterrupted service due to factors beyond our control, including internet outages, server maintenance, and third-party service disruptions.

6.2 Support Response Time

We aim to respond to support requests within 24-48 business hours. Emergency issues will be prioritized and addressed as quickly as possible.

6.3 Unlimited Edits

Your subscription includes unlimited content updates and minor edits. Major redesigns or significant feature additions may require additional fees and will be quoted separately.

7. Warranties and Disclaimers

7.1 Service Warranty

We warrant that our services will be performed in a professional and workmanlike manner consistent with industry standards. We do not guarantee specific results, including but not limited to search engine rankings, website traffic, or conversion rates.

7.2 Disclaimer

OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAMAD WEB DESIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Hamad Web Designs from any claims, damages, losses, liabilities, and expenses arising from your use of our services, your violation of these Terms, or your infringement of any third-party rights.

10. Confidentiality

We will maintain the confidentiality of any proprietary or sensitive information you share with us during our engagement. We will not disclose such information to third parties without your consent, except as required by law or necessary to provide our services.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date and notify you via email or through our website. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.

12. Termination

We reserve the right to suspend or terminate your access to our services if you violate these Terms, fail to make payments, or engage in conduct that we deem harmful to our business or other clients.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Chicago, Illinois.

14. Entire Agreement

These Terms, along with our Privacy Policy and any written agreements between you and Hamad Web Designs, constitute the entire agreement regarding our services and supersede all prior agreements and understandings.
